ONGOING SUPPORT

  1. The first 30-day period of service (the trial period) is free of charge. To avoid charges please send us written notice to cancel before the trial period ends. If you do not send us written cancellation before the end of the trial period the standard fees shall become due and payable. The ongoing monthly management fee is as quoted in the Authorization and is subject to periodic review. One month’s written notice will be provided in connection with any change in the monthly management fee.
  2. The tenancy management service is designed to provide comprehensive, office-based support for ordinary, day to day management issues arising out of the tenancy agreement. Any extraneous work that Saunders 1865 is required to do that is outside the ambit of ordinary day to day management (e.g. handling renewing/extending the tenancy agreement or managing its termination; attendances outside Saunders 1865’s offices; work in relation to legal disputes; management of projects costing in excess of £1,500) shall be subject to extra charges. However, no additional charges shall apply unless any such work has been authorized by you.
  3. Pricing contained in any proposal is valid for such period as is specified in the proposal or for a maximum of 28 days from the date of the proposal whichever comes first.
  4. Either you or Saunders 1865 may terminate the management service by giving not less than one month’s notice in writing. However, the service will automatically come to an end at the termination of the tenancy agreement.
  5. Client is entitled to a 10% reduction on our standard fees for tenancy renewal or lease termination programs. Click here for the details of the tenancy renewal program and here for the details of the lease termination program
  6. All invoices/requests for payment are payable on receipt and shall be delivered by email unless otherwise agreed. Client may not withhold payment of any invoice or other amount due to Saunders 1865 by reason of any right of set-off or counterclaim which Client may have or allege to have or for any reason whatsoever.
  7. Clients are asked to meet all requests for payments promptly to avoid unnecessary administrative and financing costs. It is fundamental to the contract between us that payment must be made on time. Overdue payments will attract late payment charges and contractual interest as set out here
  8. Value Added Tax (VAT) is payable in addition at the prevailing rate wherever applicable on all items.
  9. Disbursements/expenses reasonably incurred (including mileage or other travel expenses) are payable in addition.
  10. Any payments made by credit or debit card will be subject to a 4% surcharge which will be billed to you together with any other disbursements/expenses.
  11. LEGAL & TAX MATTERS: Saunders 1865 employ experienced property managers. However, we are not lawyers and we are not qualified to provide legal advice. If legal advice is required by the client or assignee, a qualified lawyer must be consulted. Similarly we are not qualified to give tax advice. If tax advice is required the client and or assignee must seek the advice of a qualified tax accountant.
  12. Saunders 1865 maximum liability in respect of any assignment, whether for breach of contract, negligence or otherwise, shall be equal to the total amount of the fees charged to the client.
  13. If any provision of these terms are held invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction, such provision shall be severed and the remainder of the provisions of these terms shall continue in full force and effect as if the terms had been executed with the illegal or unenforceable provision eliminated. The parties irrevocably submit to the exclusive jurisdiction of English Courts for the determination of any dispute.
